By creating an account or using the Smart Gym Pal application or website ("Service") you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.
Description of Service
Smart Gym Pal provides an AI-powered fitness application that generates personalised workout routines and nutrition plans. The Service is provided for informational and wellness purposes only and does not constitute medical, nutritional, or professional fitness advice.
Eligibility
You must be at least 16 years old to use the Service. By registering you represent that you meet this age requirement and that all information you provide is accurate.
User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@smartgympal.com if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these terms.
Subscriptions and Billing
The Service offers free and paid subscription tiers. Paid subscriptions are billed in advance on a monthly or annual basis. You may cancel at any time; access continues until the end of the current billing period. No partial-period refunds are issued unless required by applicable law. Prices may change with 30 days' notice.
Acceptable Use
You agree not to use the Service to: (a) violate any applicable law; (b) upload malicious code or interfere with the Service's infrastructure; (c) scrape or automate access beyond normal app usage; (d) impersonate any person or entity; or (e) share access credentials with others.
Health Disclaimer
The workout and nutrition plans generated by Smart Gym Pal are based on the information you provide and general wellness principles. Always consult a qualified healthcare or fitness professional before starting a new exercise programme, especially if you have a medical condition, injury, or are pregnant. Smart Gym Pal is not liable for any injury, illness, or adverse outcome resulting from following generated plans.
Intellectual Property
Smart Gym Pal retains all rights to the Service, its code, design, and content. You retain ownership of the personal data you input. You grant us a limited licence to process that data to provide the Service.
Limitation of Liability
To the fullest extent permitted by law, Smart Gym Pal shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notification at least 14 days before taking effect. Continued use after that date constitutes acceptance.
